1.

A discussion regarding tiered water rates

During the water conservation discussions earlier this year, Public

Works offered to review the tiered water rates of the City with the Council including:

  • What was discussed previously including the rate study
  • A review of the options presented to the Council
  • Additional options that may be appropriate

Council Leadership has asked that this item be placed on the Work Meeting agenda.

Abi Maccabee, Municipal Council Intern has been researching other cities nearby and will be briefing the Council on their tiered water rate structures along with some academic pros/cons for their use. Following Abi, Public Works staff will present.


2.

A discussion regarding water conservation initiatives

During the November 1st, 2022 Council Meeting, the Council set aside $57,635 of ARPA dollars for the express purpose of water conservation. That

money has yet to be allocated for a specific use. During the June 6th Budget Work Meeting, the Council indicated that they would potentially like to use the funds on a Parks Division project. Two proposals that were discussed specifically were (1) outfitting City parks that lacked smart controllers with them or (2) flipping City strips such as the one on Center Street.


The Council Office reached out to the Parks Division to present on this topic and provide a list of potential water conservation related projects this money could either cover in its entirety or supplement.

A presentation regarding the River District Project & boundary line adjustments

As part of the new River District residential and commercial development in north Provo, the developers are exploring the potential of a boundary

line adjustment with the City of Orem. This presentation's aim is to inform the Council on the proposed line adjustments including how the change would affect Orem and Provo property and infrastructure in the development.

An Ordinance amending Provo City Code to allow meeting halls for rent as a conditional use in the Agricultural Zone and establishing standards for that use

Barry Finch requests Ordinance Text Amendments to Section

14.08.020 (Permitted Uses in the A1 Zone) to add "Meeting Halls for Rent" as a new conditional use in the A1 (Agricultural) Zone, as well as new conditions in Section 14.34.250. The request is related to a proposal to build a new commercial structure on the property at 310 South 2470 West to rent out for a variety of events. Though the applicant is applying for his situation at his property, this request would apply to all A1 and RA zones in Provo, thereby allowing this new commercial use on any agricultural or residential agricultural land in the city. A map to show those areas has been included in the attachments to this report. As a way to try to mitigate possible adverse impacts caused by meeting halls for rent being allowed in these zones, the applicant has worked with staff to now provided some standard conditions related to parking, noise, security, design, lighting, and access for these sites.


5.

A discussion regarding zoning code

 During the May 2nd Work Meeting, the Council discussed the possibility of embarking on a comprehensive zoning update. This presentation is a

report back on the motion from that meeting which instructed staff to "report back within five months with recommendations as to the next steps, an outline of a new zoning ordinance, and a scope of work." During the meeting we would like progress towards the following three decisions:


1. Do we want to move forward with the project?

2. Are there any additions or deletions to the scope of work?

3. Where will the funding for this project come from?


6.

A discussion regarding unreinforced masonry buildings

This item is a follow up from the June 20th Work Meeting. The

Council specifically asked for more information regarding potential costs to the City for a "Fix the Bricks" style program. In short, the City is reimbursed by the grant for the costs of the project. The only explicit costs to the City would be the requirement to match 25% of the administrative costs.


  • Staff will review the four policy options which include:
  • Encourage the Administration through resolution to pursue a pre-mitigation grant program
  • Encourage and partner with the Administration through resolution to engage in a public information campaign
  • Amend the City Code to include a URM disclosure requirement
  • Train the neighborhood district board members in community response
  • Maintain the Status Quo


Chris Blinzinger, Emergency Management Coordinator will give his opinion on what options are the best to help to mitigate the unreinforced masonry structure issue.


7.

A presentation regarding the Quarterly Report for the 3rd Quarter of Fiscal 2023

Provide an overview of the revenues and expenses for the 3rd Quarter of fiscal 2023.

The Municipal Council or the Governing Board of the Redevelopment Agency will consider a motion to close the meeting for the purposes of holding a strategy session to discuss pending or reasonably imminent litigation, and/or to discuss the purchase, sale, exchange, or lease of real property, and/or the character, professional competence, or physical or mental health of an individual in conformance with 52-4-204 and 52-4-205 et. seq., Utah Code.

A presentation of the Environmental Stewardship Award to Provo City

The mission of the Utah Valley Earth Forum (UVEF) is "to help improve and protect the environment of Utah Valley and beyond for the betterment of all

people and nature, for now and all future generations." Throughout the year, the UVEF "identifies individuals, businesses, organizations and communities that make exceptional contributions to environmental stewardship or sustainability."

An ordinance amending the General Plan to adopt the Conservation and Resiliency Plan

The full text of the Conservation and Resiliency Plan can be viewed at

The proposed Conservation and Resiliency Plan builds on themes introduced in the Resource Management chapter of the General Plan. It is not required by state statute, and there are no external criteria for the plan.


The Conservation and Resiliency Plan addresses eight elements of environmental

sustainability:

• Carbon Emissions

• Air Quality

• Renewable Energy

• Urban Nature

• Waste Diversion

• Water

• Mobility

• Fire Risk


For each element, the plan gives the 2019* metrics as well as targets for 2030 and 2050, contextual explanations, a list of resources for more information, and goals to help the City reach the targets. A quick overview of the targets and definitions for each of the eight elements can be found on pages 16-17 of the Conservation and Resiliency Plan as well as in Appendix A of the attached staff report.


* Staff and the consultants selected 2019 as the baseline year to avoid the effects of the COVID-19 pandemic in 2020-2021, which impacted the data for almost all of the eight elements. When staff revised the document in 2022, data for that year was not yet available.
