Council meeting agendas are often difficult for people to navigate. Filled with jargon and legal requirements on how an item must be listed, it can be a challenge to determine what Council members are actually discussing or deciding on. 

What follows is a staff interpretation of the agendas.

A discussion on an ordinance amending Provo City Code regarding location of boats, recreational vehicles, and trailers, Section 14.34.060. Citywide Application. PLOTA20230034

Section 14.34.060 of the Provo City Code currently regulates the

location of boats, boat trailers and travel trailers in residential zones of Provo City. Development Services Department wishes to amend the text of this section to clarify the wording as well as include Trailers, along with a definition of Trailers in section 14.06.020. It is believed that this will allow for a more equitable enforcement of trailers in general throughout Provo City Residential Zones.

A discussion on an ordinance amending Provo City Code regarding downtown parking in Sections 14.21A.150 and 14.21B.140 PLOTA20230094

The Development Services Department is requesting approval of text amendments to the General Downtown (DT1) and Downtown Core (DT2) Zones in order to add parking exemptions for some existing structures in portions of downtown Provo. These exemptions would only be for existing buildings when a change of use occurs and would not apply to any new expansion of the buildings within the defined area. The specific area (shown in the attachments) identifies the area for which this exemption would be applicable and runs from 500 West to 100 East on Center Street, and Center Street to 300 North on University Avenue. This area includes 115 properties, of which 105 have very little or no off-street parking on site. 63 of the properties are within the official Provo Downtown Historic District, which runs from 300 West to 100 East along Center Street. The proposed amendments state that buildings that have frontage in the area described above will not be required to provide any new off-street parking unless there is an addition.

A presentation regarding the LTAP Concrete Report. (23-047)

Recently, a comprehensive sidewalk assessment was conducted by the Utah Local Technical Assistance Program from Utah State University. The purpose was to obtain budget estimates and suggested priorities for proper sidewalk maintenance, obstruction removal, and accessibility ramps. Council leadership requested that the Engineering Division report to the Council as a whole on the LTAP study and highlight missing sidewalk capital projects, existing sidewalk conditions & distress, project plan processes, and budgets.


A presentation regarding efforts addressing homelessness in Provo City - Mountainland Continuum of Care (23-018)

 In an effort to understand more about resources dedicated to homelessness, various community partners will present about the work they do in Provo City and the greater Utah Valley region. This week's presentation will be from the Mountainland Continuum of Care.

A presentation Fiscal Year 2023 Year End Cleanup Appropriations. (23-008)

Near the end of each fiscal year, Finance reviews the budget to see if any shortages are projected. For example, in FY23, the Streets Division had to spend significantly more on salt and overtime due to the record-breaking amount of snow received. This is necessitating a year-end appropriation so that the division has sufficient budget to make it through the end of June. Having sufficient budget is important for governmental funds since shortages result in audit findings. Finance will review other areas of the budget to see if any additional appropriations related to budget shortages will be necessary. In addition to budget shortage appropriations, Development Services is requesting that scooter revenue received in FY23 be appropriated to cover wayfinding costs. We will provide more information about the exact appropriation needs and amounts closer to the meeting date.

A discussion regarding the adoption of the 2023-2024 Annual Action Plan. (23-027)

This is the Annual Action plan allocating funds and setting goals for

CDBG and HOME funding. This is year 4 in the 20-24 Consolidated Plan

A discussion on an ordinance amending city code regarding apartment building signage requirements. (23-048)

 During the May 2nd Work Meeting, the Council motioned to direct staff to prepare an amendment requiring apartment buildings to post a sign listing the contact information of the property and or maintenance manger. The intent was to facilitate open lines of communication between tenants & landlords and to provide a channel for prompt/efficient maintenance services to residents. 

 

8.

A discussion regarding property tax (23-008)

 If the Council wishes to enact the Truth in Taxation process, it must adopt a proposed tax rate on or before June 22, 2023. The purpose of this presentation is to inform the Council on a variety of options to increase revenue via property tax. Council Staff will present a variety of scenarios and forecasts. The last property tax increase occurred last year and consisted of a 2.9% increase in the General Operations portion of the property tax levy.

A discussion regarding housing affordability strategies. (23-043)

As part of the Council's priority to discuss housing affordability in Provo, this discussion aims to assess various strategies the Council may take to improve housing attainability for residents.

A discussion regarding RDA strategy (23-045)

Steve Turley is requesting approval of a zone change at 2075 West Center Street that would replace approximately 2 acres of the existing R1.8 (OneFamily Residential) zone on the north portion of the parcel with the MU (Mixed Use) zone and leave the remainder of the lot as undeveloped R1.8 zoned land. The property is surrounded by mostly detached one-family dwellings, with R1.8 zoning to the west and south and R1.8PD zoning to the southeast. The property to the south of this lot is currently vacant, and there is a PF zone on one parcel to the east for a fire station. To the north and northeast of the property is the CG zone which includes the 7- 11 and some vacant commercial parcels that are home to temporary commercial uses at times. The dominant land use in this area are single-family homes, with around forty (40) one family detached dwellings within five-hundred feet (500’) of the subject property.

1. An ordinance amending Provo City General Plan Appendix C regarding annexation map and policies. Citywide application. (PLGPA20230063)

Staff have reviewed the General Plan policies against some of the properties in areas five and six and have determined that the policies on land use for annexation need to be amended. There are agricultural lands in these annexation areas that would have to come in as Open Space zoning under the current policies. Adding language to allow agricultural properties to come in under agricultural zoning will simplify the process for annexation and ease the burden on these agricultural landowners. The language change would only apply to properties previously used for agriculture and that are intended to remain in agricultural production.

Parkstrips are currently limited to 60% non-vegetative coverage while xeric landscaping in front yards requires a minimum of 35% vegetative coverage (not including trees and weeds). By amending the requirements for both parkstrips and yards to a minimum of 40% vegetative coverage (not including trees), the City can standardize language while slightly increasing the amount of vegetation required for xeric landscaping. Staff recommend that the minimum vegetative coverage requirement for interior landscaping strips in a parking lot be increased from 35% to 40% to remain consistent.


4. An ordinance to amend the General Plan Appendix S: Downtown Master Plan to update the document policies, graphics, and data. (PLGPA20220362)

The Downtown Master Plan (Plan) encompasses most of the Downtown Neighborhood and edges of seven adjacent neighborhoods including: Dixon, Timp, North Park, Joaquin, Franklin, Franklin South, and East Bay. The portions of the Downtown Neighborhood that are not addressed in the subject Plan are included in the Maeser, Joaquin and Franklin Neighborhood Plans. Future or amended plans developed by the City—specifically the Transportation Master Plan, the Bicycle Master Plan, the Parks and Recreation Master Plan, and any station area plan that overlap the downtown area—should reflect the policies of this document.


 5. A presentation regarding the Redevelopment Agency of Provo City Corporation. (23-045)This presentation and discussion's purpose is to review the role, projects (past, current, and future), and finances of the RDA of Provo City.


6. A presentation regarding an appropriation for a new golf cart storage building at Timpanogos Golf Club. (23-046)

As part of the golf course’s effort to become the most environmentally sustainable facility in the region, we are needing to add a new cart storage facility that will be the groundwork for a 100% electric cart fleet. The current cart storage area only holds 38 carts and has not allowed the course to convert its 80 carts to electric. This building will hold and be able to charge 80 electric golf carts. We are hoping upon completion of the facility we will transition to an electric fleet within 2 to 3 years when electric cart pricing normalizes. The opportunity to build the building now is driven by a partnership between the new Noorda Osteopathic Medical School and the completion of their new roadway and campus. The Noorda Osteopathic Medical School has agreed to pay for the concrete slab for the building. The total cost of the project is $381,000. Funding for this project will be from an internal loan from the Parks and Recreation Department CIP Fund that will be paid back over 7 years from golf course revenues.

In an effort to understand more about resources dedicated to homelessness, various community partners will present about the work they do in Provo City and the greater Utah Valley region. This week's presentation will be from the Food and Care Coalition. 8. A presentation regarding the Quarterly Report for the 2nd Quarter of FY23. (23-020)

Provide an update to the Municipal Council and residents on the revenues and expenses for the second quarter ending December 31, 2022 for the fiscal year ending June 30, 2023.


9. A presentation regarding the projected revenues for Fiscal Year 2023-2024. (23-008)

As part of the discussions regarding the proposed tentative budget for Fiscal Year 2023-2024, this presentation will review the revenue projections from all various streams including comparisons to previous fiscal years. 


10. A presentation regarding the FY 23-24 Consolidated Fee Schedule. (23-008)

As part of the review of the proposed tentative budget for Fiscal Year 2023-2024, this presentation will review the changes to the fee schedule by department and/or division.


11. A presentation regarding transfers in the proposed tentative FY23-24 budget. (23-008)

As part of the review of the proposed tentative budget for FY2023-2024, this presentation will review the budgeted transfers between utility funds and the general fund. 

 

12. A discussion regarding the General Fund (23-008)

This presentation will go over expenses and revenues in the General Fund, analysis of several financial ratios, and select other data points regarding the General Fund. The purpose is to help Councilors with understanding both the overall health of the fund and where money is being allocated within the fund as a whole. Overall, the General Fund presents a balanced budget.


13. A presentation of the FY2024 Tentative Budget and Council Priorities (23-008)

This presentation will review the FY2024 Tentative Budget and the Municipal Council priorities that have been included. The purpose is to discuss the Municipal Council priorities that have been funded and unfunded and evaluate the need for any changes to the Final Budget.

As part of the annual budgeting process, the administration will present the proposed tentative budget for the upcoming fiscal year. Over the next two months, the Council will meet to discuss the budget, make changes, and vote on and adopt a final FY23-24 budget for the Redevelopment Agency of Provo. 


Stormwater Service District of Provo

2. A resolution tentatively adopting a proposed budget for the Provo City Stormwater Service District for the Fiscal Year beginning July 1, 2023 and ending June 30, 2024.  (23-008)

As part of the annual budgeting process, the administration will present the proposed tentative budget for the upcoming fiscal year. Over the next two months, the Council will meet to discuss the budget, make changes, and vote on and adopt a final FY23-24 budget for the Provo City Stormwater Service District.

4. An ordinance amending the General Plan Map of Provo City to include General Plan Map amendments previously adopted in ordinances 2022-37, 2022-38, AND 2022-56. Citywide Application. (Related to PLGPA20210364)

Staff inadvertently left off a few localized General Plan amendments (see Ordinances 2022-37, 2022-38, and 2022-56), which were adopted by the Council at the later end of 2022, from the (entire) General Plan Map revision adopted by Council on January 17, 2023. This proposal would restore these localized General Plan amendments to the (entire) General Plan Map. Staff spoke with the City Attorney's Office and it appears this proposal would not need to go to the Planning Commission because they have already given a recommendation on these localized General Plan amendments.
