Citizens Agenda

Council meeting agendas are often difficult for people to navigate. Filled with jargon and legal requirements on how an item must be listed, it can be challenging to determine what Council members are discussing or deciding on. 


What follows is a staff interpretation of the agendas.

Work Meetings are designed to be a less formal venue for discussion among Council Members. Generally, no public input is taken during the meeting.

 

Business

1.    An ordinance amending the General Plan Map classification of approximately 24 acres generally located at 3450 West Center Street from Residential (R) to Airport-Related (AR). Fort Utah Neighborhood. (PLGPA20220334)

  • Keaton Morton is representing the ownership group for the property at approximately 3450 West Center Street in applying for a General Plan Map Amendment. The request is to change the General Plan designation from Residential to Airport Related in anticipation of a new industrial park. The proposal would make the property similar to the land across Center Street, to the south, in that it would allow for airport-related activities. Specifically, the proposal for this property is to create a new flex warehouse business park that would complement and make use of the proximity to Provo Airport, adjacent major roads, and proximity to freeway interchanges. Amending the General Plan for this area would allow the applicant to move forward with their design plans and rezone application.

2.    An ordinance amending the General Plan Map classification of approximately 11.07 acres generally located at 3410 West Center Street, from Residential (R) to Airport-Related (AR). Fort Utah Neighborhood. (PLGPA20220338)

  • Ryan Thompson is representing the ownership group for the property at approximately 3410 West Center Street in applying for a General Plan Map Amendment. The request is to change the General Plan land use designation from Residential to Airport Related in anticipation of a new flex warehouse development. The proposal would make the property similar to the land across Center Street, to the south, in that it would allow for airport-related activities. Specifically, the proposal for this property is to create a new flex warehouse business park that would complement and make use of the proximity to Provo Airport, adjacent major roads, and proximity to freeway interchanges. Amending the General Plan for this area would allow the applicant to move forward with their design plans and rezone application.

3.    An ordinance amending Provo City Code to clarify language in Titles 14 and 15. Citywide application. (PLOTA20220359)

  • Provo City Planning Staff has been compiling a list of needed changes to the zoning code over the last year. The proposed changes are only to make corrections or to better clarify standards. None of these proposed amendments make substantive changes to code regulations or to the spirit of the individual code sections but are simply correcting errors that staff has found over the course of the previous year.

4.    An ordinance amending the Provo City Code to make corrections and updates throughout the city code regarding the Neighborhood District Program. (22-055 & PLOTA20220370)

  • In August 2022, the City Council made changes to the City’s Neighborhood Program, creating the Neighborhood District Program, which will go into effect in January. During a comprehensive review of the City Code for discrepancies with the revised Neighborhood District Program, staff identified a number of sections in Titles 14 and 15 that require updates.

5.    A resolution appropriating funds in the General Fund for a sales tax increment post-performance payment to Parkway Village. (22-063)

  • On November 15, 2016 the Municipal Council approved a resolution authorizing the Mayor to execute an agreement between Provo City and Parkway Village LLC, the ownership group of the Parkway Village shopping center located at 2255 North University Parkway. At the meeting the Council was presented with a request to reimburse the ownership group for certain extra-ordinary demolition, development and construction costs associated with the removal of an existing occupied retail pad, participation of the installation of a new traffic signal and the construction of a replacement retail pad. The reimbursement would be funded through retail sales tax increment above the established predetermined sales tax revenue actually generated by the retail center as of a certain date.    

6. A presentation regarding a progress report on the Innovation Grant Funding Program. (22-086)

  • To hear from several of the award recipients about their innovative idea, how it was deployed, and the benefit it has yielded to the department and to the City.

7. A discussion regarding Provo-Orem Dispatch Services Agreement. (22-047)

  • Provo and Orem city staff members have been working for the last several months to finalize an agreement with the City of Orem to provide emergency dispatch services for them.  This effort will have substantial benefits for both cities in reducing overhead costs, improving the reliability of dispatch services, accomplishing the goals of the State Legislature in improving dispatch efficiency statewide, and improving 911 response on our large common boundary with Orem City.

  • We are in the very final editing stages of the services agreement.  We expect to have the final agreement ready for adoption by the Council at the first Council meeting in January.

8. An ordinance amending Provo City Code regarding towing operations to add a grace period for patrol tows. (22-076)

  • This presentation is a follow-up on questions Councilors had regarding the code about a grace period for patrol tows.

9. A resolution adopting the revised Provo Moderate-Income Housing Supply and Strategies Report. (22-069)

  • The Moderate Income Housing plan was previously adopted to meet the State's required October 1 submission. After the State reviewed this General Plan element, they sent it back with some required revisions. We have completed those revisions and would like to gain Council approval on those revisions in order to resubmit to the State.

10. Development Services requests a complete revision of the Provo General Plan to guide growth and development for the next 10 to 20 years in Provo. Citywide application. (PLGPA20210364)

  • A general plan is a visioning document that sets long-range goals and plans for how a city will grow over the next 10 to 20 years. It helps guide citywide policy decisions and priorities and inspires a city to look toward the future. General plans are also required by state statute, and this proposal meets the current requirements.

1.    A presentation recognizing the Provology Fall 2022 class graduation. (22-085)

  • In recognition of our Provo residents for their participation and completion/graduation from Provology.

2.    A public service announcement from Provo School District's Center for Advanced Professional Studies (CAPS) on water conservation. (22-044)

  • The Provo School Districts CAPS program has been working with the City Administration, Public Work, and Provo City Channel 17 Media Services to develop a water conservation Public Service Announcement, thanking the Provo residents for conserving millions of gallons of water and encouraging them to keep up the good work.

3.    A resolution consenting to the Mayor's appointment of the Chief of Police for Provo City. (22-083)

  • After advice and consent from the Provo City Municipal Council, Mayor Kaufusi seeks to appoint a new Provo City Police Chief.

4.    A joint resolution from the Provo Mayors Office and Municipal Council in recognition of Dr. Richard "Rick" Nielsen as the Founding President & CEO of Rocky Mountain University of Health Professions. (22-044)

  • A joint resolution from the Administration and Council to recognize the significant contribution to the health professions in Provo City, Utah Valley, and the State of Utah for the dedicated service, vision, and determination to bring about the founding and operation of Rocky Mountain University of Health Professions and the Noorda College of Osteopathic Medicine as the founding President and CEO of both institutions of higher learning.

5.    A resolution adopting the 2023 Council regular meeting schedule. (22-084)

  • Each year, the Council must formally adopt the meeting schedule for the coming year and post the approved schedule in accordance with state law.

  • On November 15, 2016, the Municipal Council approved a resolution authorizing the Mayor to execute an agreement between Provo City and Parkway Village LLC, the ownership group of the Parkway Village shopping center located at 2255 North University Parkway.  At the meeting, the Council was presented with a request to reimburse the ownership group for certain extra-ordinary demolition, development, and construction costs associated with the removal of an existing occupied retail pad, participation in the installation of a new traffic signal, and the construction of a replacement retail pad.  The reimbursement would be funded through retail sales tax increment above the established predetermined sales tax revenue actually generated by the retail center as of a certain date.  The baseline revenue was established at $136,476, which represents one-half of one percent of total sales generated at the center or that portion of sales tax revenue received by Provo City from the retail center, as provided by the State of Utah.  In this agreement, Provo City will continue to receive the baseline amount of $136,476.

9.    A presentation of the Annual Comprehensive Financial Report (22-085)

  • After the completion of Provo City's audit, the Finance Division, in conjunction with HBME auditors, prepares the Annual Comprehensive Financial Report for the prior fiscal year. In this meeting, we will be presenting an overview of the Fiscal Year 2021-2022 Financial Report.

10.  An ordinance amending Provo City Code regarding towing operations to add a grace period for patrol tows. (22-076)

  • This presentation is a follow-up on questions Councilors had regarding the code about towing signage, charges/costs, and delivery vehicle exemptions.

11.  An ordinance amending the Provo City Code to make corrections and updates throughout the city code regarding the Neighborhood District Program. (22-055 & PLOTA20220370)

  • In August 2022, the City Council made changes to the City’s Neighborhood Program, creating the Neighborhood District Program, which will go into effect in January. During a comprehensive review of the City Code for discrepancies with the revised Neighborhood District Program, staff identified a number of sections in Titles 14 and 15 that require updates. The code amendments from Titles 14 and 15 have gone to the Planning Commission on December 7, 2022. In addition to these items, there are several cleanup items from other sections of the City Code.

15. An ordinance amending the zone map classification of approx. .22 acres of property located at 1220 East 960 South, from One Family Residential (R1.8) & Residential Conservation (RC) to Low-Density Residential (LDR). Provost South Neighborhood (PLRZ20220244)

  • The applicant is requesting approval for a parcel of vacant land that is in the R1.8 zone, along with a small portion of land that is in the RC zone, to be rezoned to the LDR zone. The purpose of the rezoning would be to allow for a new twin home to be built on the land that is being rezoned. The proposed rezoning area will consist of approximately 0.22 acres of land. The smaller parcel A (seen in Attachment 2) is approximately 0.004 acres and would be purchased by the applicant and added to the 0.217 acres of parcel B. The property is currently zoned R18, like the properties to the north and to the east. The other surrounding property that is on the south and west of the property is zoned RC.

16. *CONTINUED* Amend General Plan Map for Joaquin Neighborhood Plan (Appendix H1) to change the Future Land Use Map (Fig 3.3) from a RC designation to a HDR designation, in order to rezone & build an apt. building in the RC zone. (PLGPA20220315)

  • The applicant is requesting a General Plan Map amendment to support a proposed zone change to allow for a new apartment building to be constructed. The Future Land Use Map in the Joaquin Neighborhood Plan has this area designated as Residential Conservation (RC). The purpose of the Future Land Use Map is to help guide land-use decisions to achieve a larger purpose in the neighborhood. The larger neighborhood goal is to allow for higher-density housing to be located closer to the University campus in the northern portion of the neighborhood and to protect the historic character of single-family housing below 500 North.
