Citizens Agenda



Council meeting agendas are often difficult for people to navigate. Filled with jargon and legal requirements on how an item must be listed, it can be a challenge to determine what Council members are actually discussing or deciding on.

What follows is a staff interpretation of the agendas.

Work Meetings are designed to be a less formal venue for discussion among Council Members. Generally, no public input is taken during the meeting.

Business
  1. A presentation on Wastewater planning (17-131)
    • The Public Works Department will be presenting on financing options for either upgrading the current wastewater treatment plant or building a new wastewater treatment plant.
  2. A discussion on Police fees (17-142)
    • Acting on a request from the Budget Committee, Council has asked for a regular review of city fees to compare them to actual costs. This item will focus specifically on a review of Police Department fees.
  3. A discussion on proposed new Fire Department fees for false alarms (17-133)
    • The Fire Department will be presenting their recommendations for a ordinance regarding false alarms.
  4. A discussion on adopting the Provo Parking Strategic Management Plan as a guide for decision making and policy formation (17-126)
    • This is a follow-up to a series of discussions Council has had with Provo City’s Parking Administrator. Council will be discussing whether they would like to officially adopt the Provo Parking Strategic Management Plan, developed by Kimley-Horn Associates, at the Council meeting as a guide for decision making and policy formation.

1. The Municipal Council or the Governing Board of the Redevelopment Agency will consider a motion to close the meeting for the purposes of holding a strategy session to discuss pending or reasonably imminent litigation, and/or to discuss the purchase, sale, exchange, or lease of real property, and/or the character, professional competence, or physical or mental health of an individual in conformance with § 52-4-204 and 52-4-205 et. seq., Utah Code.
A closed meeting was held.

Business 

2.  A discussion on the process for appointing an interim mayor (17-132)
 

A motion approving the amended Council intent statement (below) regarding the process for appointing an interim was Approved 6:0, with Council member Kay Van Buren excused.
If a vacancy occurs in the office of mayor prior to the end of the year, the Provo Municipal Council will follow the procedure outlined in Utah § 20A-1-510 to fill that vacancy. It is anticipated that, if necessary, the appointment would occur at the Council meeting on December 5th. Public notice of that meeting would therefore need to be given no later than November 21st, the same day the Board of Canvassers meets to certify the election result.


The Council recognizes that this midterm vacancy situation is different from many others in that by December 5th, certified results will already exist for the election held on November 7th, by which the citizens of Provo will have selected a duly elected mayor to take office on January 1st. While the appointment process will follow State and City law, it is the sense of the Council at this time that the most appropriate course of action will likely be to appoint the mayor-elect to serve as interim mayor until the end of the year.

PUBLIC NOTICE FOR THE INTERIM APPOINTMENT OF A MAYOR
QUALIFIED PERSONS MAY APPLY FOR APPOINTMENT

PROVO, Utah – November 20, 2017 – Pursuant to the procedures outlined in Utah State Code §20A-1-510 and Provo City Code §2.10.080, the Provo City Municipal Council intends to appoint a Mayor to complete the remainder of the term vacated by now-Congressman John Curtis, which term ends at noon on January 1, 2018. The appointment of the interim mayor will occur at the regular Council meeting on December 5, 2017 at 5:30 PM.
Qualified persons may apply in person by filing a Declaration of Candidacy with Janene Weiss, City Recorder, at the Provo City Recorder’s Office located at 351 W. Center Street, Provo, Utah until 12:00 PM (noon) on Thursday, November 30, 2017.
Minimum qualifications are that a person applying for the position:
·       Be a registered voter of Provo City
·       Be a legal resident of Provo City for twelve (12) consecutive months prior to appointment.
·       Be at least 18 years of age.
·       Have no other compensated employment with Provo City.

Any mentally incompetent person, any person convicted of a felony, or any person convicted of treason or a crime against the elective franchise may not hold office in this state until the right to vote or hold elective office is restored as provided by statute (see UCA 20A-2-101.3 or 20A-2-101.5).

The Municipal Council will, in open meeting, interview each individual whose name is submitted for consideration, and who meets the qualifications for office, regarding the individual's qualifications and then will vote to appoint, on an interim basis, a mayor from among the qualified candidates interviewed.

  1. Presentations on the proposal to build a medical school on a portion of the East Bay Golf Course (17-136)
    • Provo City has received a proposal that would involve building a medical school on a portion of the East Bay Golf Course. This item will feature two presentations—one by representatives from Wasatch Educational regarding the medical school proposal and the other by representatives from the East Bay Golf Course. Staff will make concerted effort to share presentations from this discussion with the public between November 21st and the Council meeting on December 5th. The Council will receive public comment on this item at the December 5th Council Meeting. The goal is to provide details to the public and the Council regarding the medical school proposal and the current status of the East Bay Golf Course.
  2. A discussion on the Accessory Apartment Overlay Zone, the Supplementary Residential Overlay Zone, and related zoning topics(17-137)
    • At the request of various Council members, Gary McGinn from Community Development will go over the differences between the Accessory Apartment Overlay Zone (A Overlay), the Supplementary Residential Overlay Zone (S Overlay), and the provision allowing citizens who are 65 years and older to have accessory apartments. The goal is to provide Council members with a clear understanding of the differences between specific overlay zones in the City Code.

Joint Meeting with Transportation and Mobility Advisory Committee

    • Council regularly schedules meetings with key boards and commissions to discuss current issues and ways to improve processes.

  1. A discussion on a complete streets policy
    • Council and the Transportation and Mobility Advisory Committee (TMAC) have previously discussed the idea of complete streets standards. Complete streets are designed and operated to enable safe access for all users, including pedestrians, bicyclists, motorists, and transit riders. Provo City’s Transportation Master Plan lists in 11.02 for goals of the Bicycle Plan, “1. Institutionalize Complete Streets principles that encourage consideration of all road users when modifying existing roads or constructing new ones.”

Mayoral Appointment




Members of the Provo Municipal Council received a letter of resignation from Provo City Mayor John Curtis, which will become effective Monday, November 13, 2017. Curtis will be sworn into his new role as Representative at a ceremony in the United States House of Representatives at 6:00 pm EST on November 13, at which time he will no longer be Mayor of Provo City.

Provo City Code §2.10.080 provides for continuity in the Office of Mayor by authorizing the Council Chair, while continuing to serve as member of Council, to act as mayor until a successor mayor is appointed. The current Council Chair is Dave Sewell, one of two citywide representatives on the Council.

Sewell commented on the proposition of serving as acting mayor, "I have three goals during this time.  First is to keep the ship (the city) moving in the same direction at full speed, working with the excellent administrative staff that Mayor Curtis left in place.  There won't be any sudden course changes during my brief tenure as acting mayor.  My second and most important goal is help the mayor-elect have a smooth transition into office.  The third goal is to take advantage of this unique opportunity to learn more about how the administrative side of our city government works so that I can be more effective as I continue to serve on the Council."

The Council will follow the procedure outlined in Utah § 20A-1-510 to fill the vacancy. Public notice will be posted on November 20, 2017, stating how a qualified person applies to be considered for the appointment and the process for selection by the Council. The appointment of the interim mayor will occur at the regular Council meeting on December 5, 2017.

Council released an intent statement on October 31, 2017, recognizing that this midterm vacancy situation is different from many others in that by December 5th, the citizens of Provo will have selected a duly elected mayor to take office on January 1st. While the appointment process will follow State and City law, it was the sense of the Council at that time that the most appropriate course of action will likely be to appoint the mayor-elect to serve as interim mayor until the end of the year, though retaining the legal right to appoint anyone who meets the stated requirements.
